Terms & Conditions of Sale


QUOTATIONS 

Unless otherwise stated, all quotations will remain valid for a period of 30 calendar days from date of original quotation. Prices quoted are only valid if the full quotation is accepted and thereof. All quotations are subject to withdrawal or change at any time until the Customer’s order has been received and accepted. Just Bathroomware Pty Ltd reserves the right at all times to alter prices without notice.

 

STOCK AVAILABILITY 

Once your order is placed if in-store our Showroom Consultant, or for online purchases our Online Support Team will contact you to confirm stock availability, an estimated time of arrival of your goods and also discuss a suitable delivery date. Delivery will be subject to a number of factors relating to the products you wish to purchase – i.e. your delivery address and the stock availability (whether in-stock in our warehouse, or the ETA if in-stock at our suppliers’ warehouse or whether it is an indent item or a custom made or special finish item).

-If your order is a standard stock item and in stock, your order will be delivered from our Gladesville warehouse or sometimes directly from our Supplier – Typically within 7 to 14 working days to the Greater Sydney Metro area, allow more time for other areas.

-If your order is a Custom Made to Order item (e.g. Vanity) or a product that requires a Special Finish (e.g. tapware), or if it is an Indent Item, our Support team will contact you as soon as possible, and inform you of an estimated time of delivery.

-If there are any delays or unexpected shortages of a particular product our Customer Service team will contact you as soon as possible, and inform you of any issues, shortages or to update you with the estimated time of delivery.

 

AVAILABILITY 

Every effort will be made to complete orders by the date required, however Just Bathroomware Pty Ltd shall not be held responsible should delays occur as a result of external suppliers and due to circumstances beyond our control. Any delivery date(s) and/or time(s) quoted are given in good faith, but Just Bathroomware Pty Ltd will not be subject to incur, and the purchaser or any third party hereby expressly releases Just Bathroomware Pty Ltd from any claim, action or liability whatsoever, arising from or because of any delay in delivery including manufacture, shipping delays, strikes, breakdown of machinery or arising out of any unexpected or exceptional cause, or any cause beyond Just Bathroomware Pty Ltd reasonable control.

 

STORAGE – All goods shall be accepted for delivery by the purchaser within 30 days after Just Bathroomware Pty Ltd has given notice to the purchaser that the goods are available for collection or delivery. The purchaser will be liable for all costs and charges, including for storage, arising from not accepting delivery within 30 days.

**After this time, all goods must be paid for in full, and a storage fee will be applicable.

 

PAYMENTS 

We accept Credit Cards (Visa, MasterCard, Amex), EFT and for in-store purchases we also accept Cash. Payment in full is required before delivery or pick-up, or after exceeding storage condition above.

  1. Placing an Order for Products
    1. You may order Products by selecting and submitting your order through the Site in accordance with these terms and conditions.
    2. Any order placed through this Site for a Product is an offer by you to purchase the particular Product for the price notified (including the delivery and other charges and taxes) at the time you place the order.
    3. We may ask you to provide additional details or require you to confirm your details to enable us to process any orders placed through the Site.
    4. Prior to placing an order through the Site, you acknowledge that we do not conduct any site or physical inspections of the proposed installation location and you must ensure that the Product is suitable for your requirements and needs.
    5. You agree to provide us with current, complete and accurate details when asked to do so by the Site.


  2. Acceptance or Rejection of an Order
    1. We reserve the right to accept or reject your order for any reason, including (without limitation) if the requested Product is not available, if there is an error in the price or the product description posted on the Site or in your order.
    2. Each order placed for Products through the Site or any other means that we accept results in a separate binding agreement between you and us for the supply of those Products. For each order accepted by us, we will supply the Products in that order to you in accordance with these terms and conditions.
    3. If we reject an order placed through the Site, then we will endeavour to notify you of that rejection at the time you place the order or within a reasonable time after you submit your order.


  3. Cancelling an Order (by Us)
    1. Prior to the dispatch of an order, we may cancel all or any part of an order (including any orders that we have accepted) without any liability to you for that cancellation if:
      1. the requested Products in that order are not available; or
      2. there is an error in the price or the product description posted on the Site or in any other sales platform in relation to the relevant Product in that order; or
      3. we consider that the postage price selected in the checkout does not match the applicable price for the delivery address; or
      4. your order weight exceeds our maximum postal delivery weight (in which case we will contact you to make alternative arrangements where possible); or
      5. that order has been placed in breach of these terms and conditions.
    2. If we do so, then we will endeavour to provide you with reasonable notice of that cancellation, and will not charge you for the cancelled order if we cancel it before the delivery date or if you are not at fault or in breach of these terms and conditions.


  4. Delivery of Products

    Please see the Shipping section of this Site for information on delivery times and costs.

  5. Prices, Fees and Charges
    1. The prices of Products and delivery and other charges displayed on this Site are current at the time of issue, however, we reserve the right to change prices at any time before we accept an order from you.
    2. All prices shown on this Site are in Australian Dollars (AUD).
    3. We will charge you, and you agree to pay, the following fees and charges in relation to an order that we accept (as applicable and without limitation):
      1. the purchase price of each Product that is ordered;
      2. the delivery fee for delivering the Products to you; and
      3. any other fees and charges set out in these terms and conditions.
    4. All fees and charges identified in these terms and conditions and all prices for the Products as shown on the Site are inclusive of GST (unless otherwise indicated).


  6. Your Obligations
    1. You covenant and warrant that:
      1. you must engage a licensed or adequately qualified tradesperson or plumber to install Products acquired via the Site;
      2. all information and data provided by you to us through the Site (including as part of the customer registration process) or otherwise is true, accurate, complete and up to date;
      3. the person receiving the Products at the Delivery Address is authorised by you to do so;
      4. you have and will comply with all relevant laws relating to your use of the Site and your placement of any order to us;
      5. you will ensure that your LoginID and password that is used to access the Site and the details of your account is kept in a safe and secure manner;
      6. you will promptly notify us if you are or become aware that there is or has been an unauthorised use of your LoginID and password or account, or any other security breach relating to your account;
      7. you will promptly advise us of any changes to your information provided to us as part of the customer registration process;
      8. you are responsible for any costs associated with your access to or use of the Site, including Internet access fees;
      9. you are responsible and liable for any person that uses your LoginID and password to order Product(s) through the Site;
      10. you agree that we may charge you for all Products that we agree to supply to you that have been ordered using your LoginID and password through the Site;
      11. you will check the labels on the Products before consumption or use; and
    2. You must not:
      1. use the Site for any activities that breach any laws, infringe a third party’s rights or are contrary to any relevant standards or codes;
      2. use the Site in a manner or way, or post to or transmit to or via the Site any material, which interferes with other users or our other customers or defames, harasses, threatens, menaces or offends any person or which prevents any other person from using or enjoying the Site;
      3. make fraudulent or speculative enquiries, purchases or requests through the Site;
      4. use another person’s details without their permission or impersonate another person when using the Site;
      5. post or transmit any obscene, indecent, inflammatory or pornographic material or any other material that may give rise to civil or criminal proceedings;
      6. tamper with or hinder the operation of the Site;
      7. knowingly transmit any viruses, worms, defects, trojan horses or similar disabling or malicious code to the Site;
      8. use any robot, spider, site search and retrieval application or other mechanism to retrieve or index any portion of the Site;
      9. modify, adapt, translate or reverse engineer any portion of the Site;
      10. remove any copyright, trade mark or other proprietary rights notices contained in or on the Site;
      11. reformat or frame any portion of the web pages that are part of the Site;
      12. create accounts by automated means or under false or fraudulent pretences;
      13. use the Site to violate the security of any computer or other network or engage in illegal conduct;
      14. take any action that imposes or that would, in our reasonable opinion, result in an unreasonable or disproportionately large load on our infrastructure;
      15. use the Site other than in accordance with these terms and conditions; or
      16. attempt any of the above acts or engage or permit another person to do any of the above acts.

  7. Warranty and Liability
    1. Seller accepts liability for all legal guarantees and warranties expressed or implied to the transactions under the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth) (ACL), or any other legislation (such as the Fair Trading Acts (or equivalent legislation) in each State and Territory) the effect of which cannot be excluded.

      WARRANTIES – All goods carry the manufacturer warranty, for domestic use only. The warranty excludes damage caused by neglect or misuse, labour costs associated with installation or removal of defective products or corrosion caused by chemicals. Proof of purchase MUST be presented.

    2. Where we are permitted by law (and subject to clause 15.1):
      1. we do not warrant or represent the suitability of the Site or a Product for any purpose;
      2. where we do not conduct an inspection of the site or proposed installation location, we do not warrant or represent that the Products will be fit or suitable for your requirements or specifications; and
      3. we will not be liable to you for indirect and consequential loss (including without limitation for loss of revenue, loss of profits, failure to realise expected profits or savings and any other commercial or economic loss of any kind) or loss or corruption of data, in contract, tort, under any statute or otherwise (including negligence) arising from or connected to the Site or the Product.
    3. Our liability to you for loss or damage of any kind arising out of this agreement or in connection with the relationship established by it is reduced to the extent (if any) that you cause or contribute to the loss or damage. This reduction applies whether our liability is in contract, tort (including negligence), under any statute or otherwise.


  8. Returns
    1. We do not accept the return of any Products on a change of mind basis. If any Product is faulty, not of merchantable quality, not fit for its intended purpose (but excluding where clause 14.2.2 applies) or does not match the description then please contact us by email at web@justbathroomware.com.au and one of our Customer Service Team will assist with your request. Or for in-store showroom purchases contact the sales consultant from the showroom you purchased your products from. We will offer a replacement Product, credit note or refund at our discretion subject to the requirements of the ACL, where applicable, and these terms and conditions.
    2. All our items are checked for damage and missing parts prior to delivery. They are sent out in good and brand-new condition. It is important to thoroughly check your Products upon delivery and to notify web@justbathroomware.com.au or the Showroom for in-store purchases within 48 hours of receiving the order, and report any shortage, discrepancy, defect, wrong specification or similar problem to the Seller as soon as you become aware of it. Where applicable, you must provide photographic evidence of any damage or defect alleged.
    3. Any claims for credits must be made in writing to our showroom sales consultant for in-store purchases or for online purchases to web@justbathroomware.com.au within 48 hours of date of delivery, otherwise you are deemed to have accepted the Products and liability for the Products.
    4. We will evaluate your return request and send you full return instructions and return address, where applicable. The postage cost for the return will be borne by you except where we subsequently deem the returned Product faulty, not of merchantable quality, not fit for its intended purpose (but excluding where clause 14.2.2 applies) or that it does not match the description on the Site in which case we will refund the postage cost to you.
    5. Please be aware that it is your responsibility to ensure that your returned item reaches us safely. We are not liable for the loss or damage of return items in transit. Please use a traceable delivery method and keep a record of your tracking number. We will contact you to confirm when a return has been received by us.
      • Goods must be in original, packaging which is in good order and condition.
      • Products are to be returned to Gladesville Warehouse at Customers expense.
      • The products have not been used, installed or install attempted.
      • Items returned for credit will only be refunded after inspection, to determine whether goods are in good order and condition and in original packaging.
      • 20% Restocking fee applies.
      • Delivery fees are not refundable.
      • Custom made to order goods (vanities, heated towel rails, mirrors etc), special finishes orders (i.e. Tapware), special order Indent items, sale items and floor stock clearance items are NON-REFUNDABLE.
      • Refunds can only be made to the same credit card as the original payment was made. Refunds for EFT or cash payments are made via EFT to customers bank account.

  9. Cancellation
    1. If you wish to cancel your order, we ask that you advise us at least 2 business day before your planned delivery date. Please note that products that are made to order (e.g. vanities made to a size and colour according to custom specifications) are unable to be cancelled after the order is placed.
    2. If a product is a standard stock line you will receive a full refund if cancelled prior to delivery but if it is an item that we order in and the supplier charges a restocking fee that fee will be passed onto you.

  10. Termination and/or Suspension of Account

    We may terminate these terms and conditions for convenience at any time on notice to you. Without qualifying the foregoing, we may immediately suspend, terminate or limit your access to and use of the Site and (where relevant) your account if we reasonably suspect that you have committed fraudulent act and/or you breach these terms and conditions.

  11. General Provisions
    1. If the whole or any part of a provision of these terms and conditions are void, unenforceable or illegal in a jurisdiction it is severed for that jurisdiction. The remainder of these terms and conditions has full force and effect and the validity or enforceability of that provision in any other jurisdiction is not affected. This clause has no effect if the severance alters the basic nature of this agreement or is contrary to public policy.
    2. These terms and conditions is governed by the laws of Australia. Each party submits to the non-exclusive jurisdiction of the courts of that place.

  12. Privacy Policy and Your Personal Information

    Refer to the Privacy Policy, which form part of these terms and conditions.

  13. Definitions
    1. Capitalised terms used are defined in these terms and conditions.
    2. In these terms:
      1. “GST” has the meaning it has in the A New Tax System (Goods and Services Tax) Act 1999 (Cth)
      2. “Liabilities” means all direct and/or indirect liability for: costs; damages; losses; claims, causes of action, accidents; injuries; deaths; law and traffic violations; and expenses including but not limited to legal fees.
      3. “LoginID” means the email address that you provided to us as part of the registration process to use the Site.
      4. “Product’ means each good or service that is advertised on the Site.


  14. ALL PRODUCT SPECIFICATIONS AND DATA ARE SUBJECT TO CHANGE WITHOUT NOTICE

    Just Bathroomware Pty Ltd directors and employees, disclaim any and all liability for any errors, inaccuracies, changes or incompleteness contained in any product specification datasheet or in any other disclosure relating to any product.

    It is the customer’s responsibility to validate that a particular product with the properties described in the product specification is correct, current and suitable for use in a particular application.
